For At-Home Dog Boarding Services

This Liability Waiver, Release, and Assumption of Risk Agreement ("Agreement") is entered into between the undersigned pet owner(s) ("Owner") and Reno-Tahoe Paw Retreat ("Provider"), an at-home dog boarding service operating in Reno, Nevada. Owner information, dog information, and signatures are collected separately via Provider's intake form and are incorporated herein by reference.

1. SERVICES

Provider agrees to provide at-home dog boarding and related care services for the Owner's dog(s) at the Provider's residence or other agreed location in the Reno-Tahoe area. Services may include feeding, walking, playtime, medication administration (if authorized), and general supervision.

2. VACCINATION AND HEALTH REQUIREMENTS

Owner represents and warrants that the dog(s) are current on all required vaccinations, including but not limited to rabies, DHPP (distemper, hepatitis, parvovirus, parainfluenza), and Bordetella, and are free of contagious diseases, parasites, and fleas/ticks at the time of boarding. The owner agrees to provide proof of vaccinations upon request. The owner further represents that the dog(s) have no history of aggressive behavior toward people or other animals that has not been fully disclosed in writing to the Provider.

3. ASSUMPTION OF RISK

The owner acknowledges that boarding and caring for dogs involves inherent risks, including but not limited to: injury from other animals or environmental hazards; illness or disease transmission; escape or loss of the animal; allergic reactions; stress-related conditions; and accidental injury or death. The owner voluntarily assumes all such risks associated with the boarding of their dog(s) with Provider.

4. RELEASE OF LIABILITY

To the fullest extent permitted by Nevada law, Owner hereby releases, waives, discharges, and covenants not to sue Provider, its owners, employees, agents, contractors, and any other persons acting on Provider's behalf (collectively, "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, injury, illness, or death to the dog(s) or any person, or any property damage, whether caused by the negligence of the Released Parties or otherwise, while the dog(s) are in Provider's care, custody, or control, or while being transported to or from the boarding location.

5. INDEMNIFICATION

Owner agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) the dog(s)' behavior, including any injury or damage caused by the dog(s) to any person, other animal, or property; (b) any breach of this Agreement by Owner; or (c) any misrepresentation regarding the dog(s)' health, temperament, or vaccination status.

6. VETERINARY CARE AUTHORIZATION

In the event of illness, injury, or emergency involving the dog(s), Owner authorizes Provider to seek veterinary care at Owner's preferred veterinarian or, if unavailable, at any licensed veterinary clinic or emergency animal hospital. Owner agrees to be solely responsible for all veterinary fees, costs, and expenses incurred. Provider will make reasonable efforts to contact Owner or the emergency contact prior to obtaining non-emergency care, but may proceed without prior contact in an emergency situation. The owner agrees that the Provider shall not be liable for any decisions made in good faith regarding veterinary care.

7. LIMITATION OF LIABILITY

In no event shall Provider's total liability to Owner for any claims arising out of or related to the boarding services exceed the total amount paid by Owner to Provider for the specific boarding period during which the claim arose. Provider shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

8. GOVERNING LAW AND SEVERABILITY

This Agreement shall be governed by and construed in accordance with the laws of the State of Nevada, without regard to conflict of law principles. Any legal action arising under this Agreement shall be brought exclusively in the state or federal courts located in Washoe County, Nevada. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof and supersedes all prior agreements, understandings, and representations. Owner information, dog information, and Owner's signature collected via Provider's separate intake form are incorporated into this Agreement by reference. This Agreement may only be amended in writing signed by both parties. The owner acknowledges that they have read this Agreement in its entirety, understand its terms, and are agreeing to be bound by its terms voluntarily.

BY AGREEING TO THIS DOCUMENT (INCLUDING VIA PROVIDER'S INTAKE FORM), OWNER ACKNOWLEDGES THAT THEY HAVE CAREFULLY READ THIS LIABILITY WAIVER, RELEASE, AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS CONTENTS, AND AGREE TO BE BOUND BY ITS TERMS. OWNER UNDERSTANDS THAT THEY ARE GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
